Unacceptable mis-selling.
They were told the age and make from the start and this is recorded in my documentation. My advice: BeSmart and look elsewhere. I would give them full marks for creation of reasons to do nothing other than take your money.
The response from BeSmart does not accurately reflect the history; in 2021 I was NOT asked for a contribution towards repair costs, they wanted a sum up front before they would look at it, that was what I declined given the summary of cover shown to me.
In the event the boiler makers representative effected the repair, unfortunately the same fault has recurred. That is an electronic component within the control computer! I have worked around this by re-booting the controls at regular intervals.
I now quote directly from BeSmarts closing reply to me:
The reason we would decline this is because your policy is for home emergencies only, you advised on the most recent call to our agent that you have a fix, albeit a temporary one, however under the
terms of the policy you have taken out we would class an emergency as someone without heating and hot water eg whereby the boiler had completely failed and was not able to produce any heating or hot water.
I have also looked at your policy and can see you choose not to add non-emergency cover at the time of sign up. This would be classed as a non emergency and therefore we would not look to cover this claim
as it falls within the terms outlined above.
I should also highlight the following under the attached terms
Beyond Economical Repair (BER) – In the opinion of our approved engineer, We are unable to repair Your boiler or, after an engineer appointed by Us has attended and diagnosed the problem
We will calculate the total cost of repair including parts and labour (including of VAT) required to repair the boiler or appliance by Us using reputable suppliers. For boilers and appliances that
are 11 years old or more, if the total cost of the repair exceeds 20% of the current retail price (including VAT) of a suitable replacement boiler, through leading UK suppliers, it will be deemed to
be beyond economical repair, and We will be unable to complete the repair. If We deem Your boiler or appliance to be Beyond Economical Repair, We will advise You that You require a new boiler
or appliance but no contribution will be made
In short, due to the age of the boiler if it were to break down as described above it is extremely likely our engineer would deem the boiler BER due to the age of the boiler and no contribution would be made.
This is not the case currently, as the boiler just needs a non emergency repair which is something you are not covered for, however should it break down in such a way I feel we should make you aware of the above terms as no assistance will be provided and any future claims declined.
Please note that BeSmart were aware of the make, model and age of my boiler when the policy was taken out, given the above statements I feel that they should have refused to cover it from the outset - and not taken several hundreds of pounds paid by monthly Direct Debit.
