**IF YOU DID NOT RECEIVE AN ITEM(S), PLEASE CONTACT YOUR LOCAL FRAUD AGENCY, OR DO SO ONLINE AT THE ANTI-FRAUD CENTRE OFFICIAL WEBSITE. NOT ONLY IS THEIR BEHAVIOUR UNETHICAL, IT IS ILLEGAL. PLEASE READ YOUR CITY'S "CONSUMER PROTECTION ACT." FOR RESIDENT'S OF ONTARIO, THE ACT STATES, "False, misleading or deceptive representation 14 (1) It is an unfair practice for a person to make a false, misleading or deceptive representation. 2002, c. 30, Sched. A, s. 14 (1). Examples of false, misleading or deceptive representations (2) Without limiting the generality of what constitutes a false, misleading or deceptive representation, the following are included as false, misleading or deceptive representations: **1. A representation that the goods or services have sponsorship, approval, performance characteristics, accessories, uses, ingredients, benefits or qualities they do not have. 2. A representation that the person who is to supply the goods or services has sponsorship, approval, status, affiliation or connection the person does not have. **3. A representation that the goods or services are of a particular standard, quality, grade, style or model, if they are not. **4. A representation that the goods are new, or unused, if they are not or are reconditioned or reclaimed, but the reasonable use of goods to enable the person to service, prepare, test and deliver the goods does not result in the goods being deemed to be used for the purposes of this paragraph." ETC. WHAT THEY'RE DOING IS KNOWN AS FRAUDULENT MISREPRESENTATION. THIS APPLIES WHEN YOU DID NOT RECEIVE ANY SUBSTITUTE FOR AN ITEM YOU PAID FOR. **WHEN YOU RECEIVE A PRODUCT THAT IS SUBSTITUTED, unfortunately there's not much you can do about it unless it is of LESSER VALUE than the product intended. It is stipulated in their Terms and Conditions that the substitute must be of equal or greater value, (this is a generally followed practice amongst most retailers as well). Alternatively, you may argue that the company is operating in bad faith, as the provision that enables this behaviour is in a HIDDEN CLAUSE within their T&C which a reasonable person would not have anticipated. In all, this company needs to be shut down. IT IS NOT ENOUGH TO TELL YOUR NEIGHBOURS NOT TO BUY FROM THEM, PLEASE REPORT THEM AND DO NOT LET THIS BEHAVIOUR SLIDE. THANK YOU. My review: According to their Terms and Conditions, "from time to time, substitutions may be necessary to fill an order in a timely manner. Some of the items in our gifts/gift baskets may be backordered, discontinued or out-of-stock. In these circumstances, we will substitute items of equal or greater value in all cases." I ordered 8 items and of the 8 items only 4 were correct, 3 items were "substituted" and one item was completely missing. I contacted customer service and they would not provide me with a refund/exchange for all the incorrect items ordered or for the item that was completely MISSING under this "condition." Completely unacceptable. If you are paying for a CUSTOM basket it is surmised that the products you receive will be accurate. At the very least, I should have been notified of this condition prior to my purchase and or given the opportunity to choose the items substituted prior to purchase. This is completely unethical behaviour. TERRIBLE customer service and for that I will not recommend this business to anyone.
