REDEMPTION OF HISTORIC LAND GRANT MADE PATENT
I am the heir to private land patent issued Feb 23, 1877, 14,198.20 Acre Spanish Grant to my Late Great Grandfatner, Miguel Avila. Rancho San Miguelito was ordered to situate within the County of San Luis Obispo, California, as Private Tract of land severed from the public domain with stipulation " Shall not affect the Interest of the third persons". 31st Congress Session II Chapter 41 Sec. 15. Whereas Subject Matter Jurisdiction For any amendment or subdivision or easement or any transfer thereof any portion of property contrary thereto decree required approval for sufficiency of title prior to acquisition (40 US Code 3111). However, random stories of provided by members of Newly created County of San Luis Obispo governing body and various private business owners who fabricated maps, surveys and fictitious deeds of trust were recorded in violation of 5th Amendment Takings without just Compensation ( Title 40 US Code 3114). Therefore it shall be now known, That The United States of America in consideration of the premesis and provisions of said act supplemental thereto Decree for the Final Distribution of land and Interest Remittance of property attached thereto Public Debt, Redemptiin determining the Gross Estate of Miguel Avila, GIVES AND GRANTS "FREE OF FEE" Title to the tract of land described within Confirmed Plat 0409, and verified final field notes, #335, Book G-47 Vol. 280 Page 761 of the Public Land survey maps, Lot 37, T32S R11E Lot 39 T31S R11E , Lot 41 T31S R12E and Lot 39 T32S R 12E, confirmed 14,198.20 Acres, commenced June of 1865 and Completed July 1875, having made patent. Feb 23 1877, In virtue of said act, HAS GIVEN AND GRANTED THE ENTIRE TRACT OF LAND, confirmed unto said Miguel Avila, and Shall Assign All Surface and Subsurface rights interest and title to His Heir, Frederic Avila, and his Heirs and Assigns Forever,, Settle Procurement of first Certificate of Title.
